Terms and Conditions

These General Terms and Conditions govern the relations between the Seller and the Consumers (clients) who use the online store www.zoraromanska.com for purchasing goods. By any use of the site, including clicking on an object, image, link (other than that of the General Terms and Conditions) or button located on the www.zoraromanska.com website, the User is deemed to be familiar with, accept and agree to the General Terms and Conditions described below and gives their explicit consent for entering into distance contracts for the purchase of goods. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA), as well as other regulations in force in the Republic of Bulgaria.

The General Terms and Conditions may be unilaterally changed by the seller ZORA DESIGN EOOD on the www.zoraromanska.com website at any time by updating them. These changes take effect immediately and are binding on every User. In each case of a change to the General Terms and Conditions, ZORA DESIGN EOOD will inform users of www.zoraromanska.com by publishing the changes on the www.zoraromanska.com website.

DEFINITIONS

"SELLER" is the company ZORA DESIGN EOOD, registered with UIC BG203324842 in the Commercial Register at the Registry Agency, which operates the website www.zoraromanska.com, constituting a virtual platform for the sale of goods. The Seller is the person with whom the User enters into a distance selling contract for a specific good (item) in the online store.

"USER" is a legally competent person who has agreed to these General Terms and Conditions in connection with the ordering and purchase of goods offered in the online store.

"ONLINE STORE" is the website www.zoraromanska.com, which serves as a virtual platform for offering goods for sale and for reaching an agreement between the SELLER and the USER for the order and purchase and sale of a specific good (item).

"GOOD / PRODUCT" is any item available on the website www.zoraromanska.com, subject to the distance contract for the purchase of goods.

"ORDER" is a request made by a User to the online store for the purchase of one or more specific goods (items). The order is packed and sent by courier to an address previously specified by the User.

"SALES CONTRACT" (hereinafter referred to as the Contract) is the distance contract concluded through this online store for the purchase and sale of goods between the Seller and the User.

"COURIER" is a merchant (provider) who physically delivers the purchased goods to an address specified by the User and operates under the requirements of the Postal Services Act.

"BROCHURE / NOTICE" are electronic informational messages relating to goods sold in the online store over a certain period, which may be posted on the Website.

 

1. CONDITIONS FOR PURCHASING GOODS THROUGH THE ONLINE STORE

1.1. The following persons may be Users: legally capable natural persons, at least 18 years of age, or legal entities, duly registered and existing, according to applicable law.

1.2. Persons wishing to place an order must fill out the order form, containing: first and last name, full and accurate contact and delivery address, email and contact phone for natural persons, and name, identification number, full and accurate contact and delivery address, email and contact phone for legal entities. By filling in the above-mentioned personal data and by giving explicit consent from the User through the respective consent forms available on the www.zoraromanska.com website (when explicit consent is required), the User gives their explicit consent for the collection, processing, storage and transfer of this personal data by the Seller in accordance with applicable law. A Privacy Policy for personal data is also available on the Seller's website, which every user of the www.zoraromanska.com website has the opportunity to review.

1.3. At the moment the order form is completed, the person wishing to place an Order, as a User, and the Seller enter into a contract, the subject of which is the provision of goods from the online store, by the Seller to the User, under the conditions set out in these General Terms and Conditions. For every subsequent purchase made by the User, requested by filling in the order form, these General Terms and Conditions apply.

1.4. The Seller allows the use of the online store by the User provided that the data specified in point 1.2. are valid and correct.

1.5. As a result of an order placed by the User by filling in the order form, the Seller creates a User profile with a username corresponding to the email filled in the order form.

1.6. The User's profile contains the data specified in the order form. In case some of the data changes in the future, the User must update it immediately by filling in the order form available on the www.zoraromanska.com site. The User has no right to delete the data specified in item 1.2. and to provide false or incomplete data while using the Seller's services through the online store. An email address must be specified for each profile.

1.7. A User may have more than one profile, but they cannot be used to perform activities that violate these General Terms and Conditions.

2. TERMS OF USE OF THE ONLINE STORE

2.1. Browsing the online store www.zoraromanska.com is completely free and accessible from all parts of the world.

2.2. To shop from the online store www.zoraromanska.com, an order is required (registration is not mandatory), which is completely free. After a successful order is placed through the newly created profile, the registered User gains the opportunity to use all the services of the store.

2.3. In the online store www.zoraromanska.com, the price, main characteristics of the goods and additional information aiming to assist in making an informed choice when purchasing the product are indicated for each good.

2.4. All prices listed on the site are in BGN (Bulgarian Lev) with VAT included and all other legally required taxes, when the purchased goods will be delivered on the territory of the Republic of Bulgaria. The prices of the goods do not include the fees under item 6.5 below, as well as the delivery costs under item 4.3 of these General Terms and Conditions, which are at the expense of the User.

3. ORDERING GOODS

3.1. To place an order with the online store, the User must fill in the necessary order data on the Seller's website.

3.2. The data for the delivery of the goods used are those provided by the User when placing their order. By sending the order, the User authorizes the Seller to contact them in any possible way when this is necessary in connection with the placed order.

3.3. Upon successful order placement, the User receives an order confirmation via email to the email address provided by them. The email confirmation includes the order number, the date the order was placed, the ordered goods, and their price.

3.4. If the ordered goods (a specific model) are not in stock, the Seller shall notify the User via email to the email address provided by them. If the User does not agree for the order to relate to another item (an analogous model), the order may be cancelled.

3.5. Orders in the online store www.zoraromanska.com are accepted 24 hours a day, 7 days a week, but are processed within 48 hours of receipt, only on official working days in the Republic of Bulgaria.

3.6. Orders placed through a User profile that contains inaccurate or incomplete User data according to these General Terms and Conditions are cancelled. If possible, the Seller sends an email to the User containing a notification of the inaccurate/incomplete data.

3.7. Before the goods are handed over to the Courier, the User may cancel a placed order, without having to state reasons for the cancellation, within 14 days of placing the order. If the goods have already been handed over to the courier, then the rules in section 7 of these General Terms and Conditions apply.

3.8. An order can be cancelled electronically via email to the email address provided on the website – email: info@zoraromanska.com or through another unambiguous statement, provided that the ordered goods have not been handed over to a courier for dispatch to the User at the time of cancellation. For the cancellation to be valid, the User must provide: the order number, their full name, and the email address they provided when placing the order, as well as the price of the order.

4. DELIVERY OF ORDERED GOODS

4.1. Delivery is made only for successfully accepted orders.

4.2. The Seller has the right to refuse to fulfill the order placed by the User, for which it must notify the User. The cancellation of the order does not entail any liability or subsequent obligation of either party to the other, except for the obligations under item 7.3 below in case the product has already been paid for by the User.

4.3. The term, price, and conditions for delivery of goods are determined by the Courier according to the Courier's terms and tariffs. The conditions and price of delivery of the products are visible to the User on the Courier's respective page, which is accessible through its active name in the text under each Product.

4.4. The costs of delivery of the ordered goods are not included in the price stated in the online store. The delivery price is determined depending on the type of goods and the place of their delivery according to the tariffs of the courier company used by the Seller.

4.5. By placing the order, the User is deemed to have given their explicit consent to pay the total value of the order, including delivery costs according to the Courier's terms and tariffs.

4.6. The ordered goods are dispatched from Monday to Friday, excluding official and national holidays celebrated in the Republic of Bulgaria.

4.7. When the ordered goods are dispatched, the User receives confirmation of successful dispatch via email to the email address provided by them. The email confirmation contains a link to the Courier's system and the tracking number for the dispatch of the ordered goods, through which the User can track the movement of the ordered goods until their arrival, as well as the delivery price, by using the Courier's website and system.

4.8. Delivery is made to the address specified by the User in the order form.

4.9. Every shipment is insured, with the insurance cost borne by the Buyer and included in the delivery price.

4.10. If the User does not provide access and conditions for the delivery of the goods at the specified address within the specified period, the Seller is released from the obligation to fulfill the requested delivery. In this case, the costs for delivery of the goods and their return by courier are at the expense of the User.

5. TRANSFER OF OWNERSHIP

Ownership of the Products will be transferred upon their handover to the User, after payment by the User. The handover of the goods will be evidenced by the User's signature on the transport document provided by the Courier.

6. PAYMENT

6.1. Payment for the ordered goods can be made according to the methods described in items 6.1.1 and 6.1.2 below.

The possible payment methods for an order are as follows:

6.1.1. By "cash on delivery" – cash payment to the courier upon delivery within the territory of the Republic of Bulgaria, Romania, and Greece;

6.1.2. via PayPal – for international delivery.

6.2. The price of each good may change dynamically. For each ordered good, the User must pay the price displayed in the online store at the time of the order.

6.3. The costs of delivery of the ordered goods are not included in the price stated in the online store and are paid separately in an amount determined by the Courier according to its terms and tariffs, based on the weight of the ordered goods.

6.4. Costs related to duties, taxes, and other fees due in connection with ordered goods that will be delivered outside the territory of the Republic of Bulgaria are paid by the User according to the applicable legislation of the country where the goods are delivered. These are in no case owed by the Seller.

6.5. For payments made via PayPal, the Seller shall not be liable for any costs related to fees, commissions, or other additional payments made by the User or their bank in connection with the transaction itself, as well as in cases of currency exchange applied by the bank, when the currency is different from BGN. The costs associated with such payments are solely at the User's expense.

6.6. Invoices are issued only in the name of the User who placed the order.

7. CANCELLATION OF CONTRACT. COMPLAINTS. RETURN OF GOODS.

7.1. The User has the right to withdraw from the contract within 14 days of receiving the goods, and for this purpose may use the Standard form for exercising the right of withdrawal from the contract, which the User received along with the goods.

7.2. In case of withdrawal from the contract, the User is obliged to return the purchased goods in an undamaged commercial condition, with preserved packaging and label, and the costs of returning the goods are borne by the User.

7.3. In case of withdrawal from the contract, if the User has paid for the goods, the amount paid for the returned goods will be reimbursed to a bank account specified by them within 14 (fourteen) days after the goods are returned. Amounts will not be reimbursed until the Seller receives the goods returned by the User or until the User provides the Seller with proof that they have sent the goods back.

7.4 The User agrees that the reimbursement of amounts will be made by bank transfer to a bank account specified by them, and this reimbursement will not be associated with costs for the User, with the exception of possible costs according to item 6.5 above. The costs associated with the transfer of the amount to the bank account specified by the User are borne by the Seller. The Courier's costs associated with the return of the goods are borne by the User.

7.5. The right to withdraw from the contract in cases where the goods have been received by the User cannot be exercised for sealed goods that have been unsealed after their delivery and cannot be returned for reasons related to hygiene or health protection.

7.6. In case of non-conformity of the received goods with the ordered goods, the User has the right to file a complaint, asking the Seller to bring the goods into conformity with the order. When filing a complaint, the User must also attach documents on which the claim is based (cash receipt, etc.). Non-conformity in what was agreed between the parties may be expressed in:

• manufacturing defects of the goods;
• missing parts of the goods;
• incorrect goods, different from the ordered ones, have been sent;
• discrepancy with the declared size and/or color - goods sent in a different size and/or different color from the ordered one;

7.7. Complaints under item 7.6 shall be submitted within two years from the delivery of the goods, but no later than two months from the discovery of the non-conformity with what was agreed. Complaints under item 7.6 can be submitted to ZORA DESIGN EOOD at the specified email address info@zoraromanska.com, and simultaneously the Consumer must send the goods for replacement within one week.

7.8. In case of a complaint, the Consumer can choose to replace the specific item with the same one without defects, or in a different size, or a different color, or return the goods against a refund of the paid amount. The Seller may offer to replace the item with a completely different item by equalizing the prices – either the Consumer pays extra if the other item is more expensive, or several items are offered for the same price, or the Consumer is refunded the difference between the replaced and the new item if the price of the new item is lower than the price paid by the Consumer. The Consumer cannot claim termination of the contract if the non-conformity of the consumer goods with the contract is insignificant.

7.9. The return of goods for a complaint, in cases other than a manufacturing defect, shall be carried out under the following conditions:

• Preserved good commercial appearance (the goods are not torn, scratched, worn, washed, ironed).
• No damage caused by improper use.
• Preserved original packaging and label.

7.10. The return of goods, whether due to withdrawal from the contract or a complaint, can be made in the manner and to the address specified in the Return Form, along with which the Consumer received the order.

7.11. When replacing goods, transport costs are at the expense of the Consumer in both directions, unless the replacement was necessary due to the Seller's fault.

8. CONDITIONS FOR COPYING INFORMATION

8.1. All information published on the website www.zoraromanska.com is the property of ZORA DESIGN EOOD , including all images, presentations, and descriptions of articles.

8.2. It is forbidden to copy texts from www.zoraromanska.com and place them on other websites and online stores without the written consent of ZORA DESIGN EOOD or without citing the source and without placing a link to www.zoraromanska.com.

9. LIABILITY

9.1. The Seller of the goods bears responsibility for defects in the goods, for the performance of the distance sales contract, as well as for the refund of paid amounts.

9.2. The Seller assumes no responsibility whatsoever if the goods sent are not delivered, are delayed, and/or damaged during their delivery by the Courier.

9.3. The Seller assumes no responsibility whatsoever if the Consumer is misled by third parties who claim to represent the interests of ZORA DESIGN EOOD

9.4 The Seller is not liable for any damages suffered by the Consumer or by third parties resulting from force majeure circumstances or circumstances beyond the Seller's control.

9.5. In all other cases, the Seller's liability is limited to the value of the ordered and paid goods.

9.6. The Consumer undertakes to inform ZORA DESIGN EOOD of any attempts according to item 9.3, using the available contact forms.

10. CONFIDENTIALITY AND PERSONAL DATA.

10.1. By entering into a Sales Contract, the Seller obtains the right to process the personal data provided by the Consumer when placing the order, for the purpose of fulfilling the concluded Sales Contract, unless the Seller's website contains another explicit request for consent from the Consumer regarding the processing of their personal data.

10.2. The Seller's activity complies with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), where the relevant information regarding personal data protection is available on the Seller's website www.zoraromanska.com.
